Justicia y Derechos Humanos: Reflexiones desde el Caso Ximenes Lopes vs. Brasil
Abstract
This article is the result of a reflective analysis of the Ximenes Lopes vs. Brazil case presented to the Corte Interamericana
de Derechos Humanos (CIDH), which addresses the death of Damião Ximenes Lopes, a person
with mental health problems who suffered abuse and neglect in a psychiatric clinic in Brazil. In the development
of the article, a comparison is made with forgotten and ignored cases from Colombia that were exposed
by the media, newspapers and news. It is essential to state that this case was a direct violation of various
human rights towards people with disabilities and in a state of vulnerability, just like the Colombian cases
mentioned. It is established that it is the duty of States to protect the integrity of people and not violate their
fundamental rights.
