EL precedente en el Sistema Jurídico Colombiano
Abstract
Judicial precedent is the legal norm with a general and abstract character, which originates in the practice
of the jurisdictional function of judicial bodies. Consequently, through this article the concept of judicial
precedent developed through the paradigms of several treatise authors, attending to its historical development
from the point of view of Common Law and Civil Law. However, it reflecting on the progress of
the precedent through the Colombian legal system, taking as its starting point the constitutions of 1886
and 1991.
